Terms of Sales
- General
1.1. These conditions of sale are concluded on the one hand by EURL Thibaud Boutinet whose head office is 1 rue du Vivier, 17 770 Saint Bris des Bois, registered in the trade and companies register of Saintes under number 792 510 299 RCS Saintes, Siret: 792 510 299 000 11. hereinafter referred to as Parc Aventure de Fontdouce and on the other hand, by any natural or legal person wishing to make a purchase at the counter, by telephone, or via the website of the Parc Aventure de Fontdouce hereinafter referred to as “the buyer”.
1.2. These T & Cs can be viewed on the website.
2 – Purpose
2.1. These conditions of sale aim to define the contractual relations between Fontdouce adventure park and the buyer as well as the conditions applicable to any purchase made by telephone, at the ticket office or through the commercial site of the Fontdouce Adventure Park, whether buyer either professional or private person.
2.2. The acquisition of a good or a service implies unreserved acceptance by the purchaser of these conditions of sale. These conditions of sale will prevail over all other general or specific conditions not expressly approved by the Fontdouce Adventure Park.
2.3. The Fontdouce Adventure Park reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.
3 – Characteristics of the goods and services offered
3.1. The products and services offered are those published on the Fontdouce Adventure Park website.
3.2. These products and services are offered within the limits of available stocks.
3.3. Each product is accompanied by a description established by the supplier.
4 – Prices and number of places
4.1. The prices appearing in the catalog are prices including all taxes in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of products or services.
4.2. The Fontdouce Adventure Park reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
4.3. Depending on the events, different types of prices may be offered to you.
4.4. All orders regardless of their origin are payable in euros.
4.5. No refund will be made in the event of loss or theft of the ticket.
5 – Orders
5.1. The buyer, who wishes to buy a product or service, must specify – His name and, if applicable, his customer number – The selected service (s), – The date of their completion – The number and age of beneficiaries
In accordance with the provisions of article 1369-5 of the Civil Code, the consumer has the possibility to check the details of his order and its total price, and if necessary to correct errors before confirming it by expressing thus its acceptance. To finalize the order, the consumer must read the T & Cs, accept them by checking a box provided for this purpose, and make payment according to the terms set out in Article 7.
5.2. Confirmation of the order implies acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions.
5.3. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.
5.4. The seller will send an order confirmation by email summarizing the purchases made, the price applied and the essential characteristics of the services ordered.
5.5. Orders for tourist products are subject to these T & Cs as well as the park’s internal regulations.
6 – Cancellation, postponement and refund
6.1. Tickets sold at the ticket office or on the internet can not be exchanged, resold or taken back. Any ticket purchased will not be refunded, even in the event that the customer has not used the ticket.
6.2. The quotation offered by telephone, accepted and signed “Good for agreement” can not be changed less than 48 hours in advance. In case of bad weather, no cancellation will be accepted. The services may be postponed to another day, depending on the consumer’s choice, on the opening days of the Fontdouce Adventure Park. In the event of complete cancellation, less than 48 hours before the scheduled date, 50% of the total amount of the accepted and signed estimate will be required.
6.3. Cancellation by the seller: in the event that the seller is forced to cancel an essential element of one of the services ordered by the consumer, the latter has a right to refuse the proposed modification and obtain a refund. Full price of the services ordered.
7 – Terms of payment
7.1. The price is payable when ordering: in full for over-the-counter and internet purchases.
7.2. Payments made by credit card on the website: they will be made through the secure system that uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and that no third party can take notice during transport on the network. The customer’s bank account will be debited for the amount of the order, upon final validation of the transaction.
7.3. Payments made by check: only bank checks drawn on a bank account opened in France and made payable to the seller are accepted. The buyer who has opted for this method of payment must present a valid identity document for any order at the counter, and accompanied by a photocopy of the identity card for a remote sale.
8 – Deliveries
8.1. After acceptance of the general conditions, the customer accepts the conditions of use of the tickets of The Fontdouce Adventure Park.
8.2. Upon confirmation of the purchase, the customer will receive an order confirmation. Buying online requires either the possession of a printer in order to print his ticket (s) on a white sheet of A4 size, or the possession of a smartphone in order to present the email and reservation number at the checkout.
9 – Ticket control
9.1. The order will be checked at the entrance to the park with an operator.
9.2. The Fontdouce Adventure Park reserves the right to check the identity of the client. The customer must therefore be provided with an official, valid identity document with a photo: identity card, passport, driver’s license or residence permit.
9.3. An undated access ticket does not guarantee access to the Fontdouce Adventure Park in the event of high attendance.
10 – Right of withdrawal
10.1. Undated access pass : for any remote purchase (over the internet) of an undated access pass or one valid for a specific period (e.g. Season Pass), the consumer benefits, in accordance with article L. 221-18 (former L.121-21) of the Consumer Code and the transcription into the French texts of European Directive 2011/83 / EU, of a withdrawal period of fourteen (14) days from receipt of the Order confirmation email. To withdraw, the consumer must notify his decision to withdraw, before the expiry of the aforementioned period, by means of a declaration without ambiguity sent by post to the following address: Parc Aventure de Fontdouce, 1 rue du Vivier , 17 770 Saint Bris des Bois, France, specifying its name, the date and the amount of its purchase.
10.2. Dated access pass : without prejudice to the foregoing and in accordance with the provisions of article L.221-28 of the Consumer Code (“The right of withdrawal cannot be exercised for contracts for the provision of services […] , catering or leisure activities which must be provided on a specific date or period ”), the right of withdrawal cannot be exercised for the remote purchase of leisure services, ordered as a package or separately, for a specific date or periodicity. Consequently, the consumer does not benefit from a withdrawal period for dated access tickets. However, if the consumer has taken out cancellation insurance when purchasing their access pass, they may be reimbursed in full for their expense. For this, the consumer must notify his decision to withdraw, by means of a declaration without ambiguity sent by post to the following address: Parc Aventure de Fontdouce, 1 rue du Vivier, 17 770 Saint Bris des Bois, France , specifying their name, the date and the amount of their purchase.
11 – Liability
11.1. The Seller is responsible for the proper performance of the Services ordered under the conditions set out in these GTC.
11.2. The responsibility of the Seller, who is only bound by an obligation of means with regard to online sales, cannot be held liable for all the inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer virus and in general any other fact expressly qualified by the case law of force majeure. The Seller cannot, under any circumstances, be held responsible for the loss or theft of Access Tickets, Vouchers or personal items of consumers that have not been deposited with the place reserved for this purpose. The Seller alone is authorized to determine the operating and maintenance conditions of the Fontdouce Adventure Park, according to his needs and / or constraints, and alone decides the opening schedule and the opening hours to the public; the services and attractions it offers as well as their conditions of use; the prices and terms of sale of the Services it offers to the public within the Fontdouce Adventure Park; the maintenance, repair, rehabilitation and renovation program for all or part of the equipment; the implementation of standards and rules concerning, in particular, the safety and health of people and property in the Park. The Seller may, at its sole discretion, decide to close public access to all or part of the Fontdouce Adventure Park for as long as necessary, in particular for the performance of work necessary for the safety and protection of visitors, or related to the maintenance, repair, renovation, of all or part of the equipment of the Park or in the event of bad weather conditions or a case of force majeure forcing the Seller to close completely or partially. The Seller’s liability can in no way be engaged with regard to consumers arriving at the entrance to the Park with an Access Pass, because of the decisions taken by the Seller concerning the operating conditions and maintenance. The Seller’s obligations are automatically suspended without liability being incurred, in the event of non-performance related to an event of force majeure or fortuitous events, such as, and without this list being exhaustive: bad weather, flood, fire , epidemic, attack, impossibility of access, decisions by authorities, strike or lockout at the Seller. The Seller will inform the consumer of the occurrence of such an event by any means. In this case, the Seller may offer the consumer another date of consumption of the Services ordered and impacted by the case of force majeure.
12 – Complaints
12.1. Any complaint relating to the reservation of Services or their performance must be addressed to the Vendor’s Complaints Department (Parc Aventure de Fontdouce, 1 rue du Vivier, 17 770 Saint Bris des Bois) by registered letter with acknowledgment of receipt within twenty (20 ) days from the performance of the Services accompanied by all supporting documents (Access Pass, Vouchers) delivered to the consumer as part of his Order. Any consumer who has not obtained a satisfactory response to his complaint within sixty (60) days after referral to the Vendor’s Complaints Department may resort to a free mediation procedure with the Tourism and Travel Mediator according to the terms set on the site www.mtv.travel/ and within a maximum period of one year from the written complaint made to the Seller.
13 – Intellectual property
13.1. All elements of the Fontdouce Adventure Park site are and remain the intellectual and exclusive property of EURL Thibaud Boutinet.
13.2. No one is authorized to reproduce, use, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound (brands, logo, distinctive signs, etc.).
14 – Personal data
14.1. In accordance with the law relating to computers, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.
14.2. The Fontdouce Adventure Park reserves the right to collect information on buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners.
14.3. Buyers can object to the disclosure of their contact details by notifying the Parc Aventure de Fontdouce. Likewise, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
15 – Archiving / Proof
15.1. The Fontdouce Adventure Park archives the purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
15.2. The computerized registers of the Fontdouce Adventure Park are considered by the parties as proof of communications, orders, payments and transactions between the parties.
16 – Special measures in the context of the COVID 19 crisis In the context of the COVID 19 crisis, the Fontdouce Adventure Park is implementing exceptional measures:• installation of plexiglass walls at reception counters
• wearing a mask compulsory for all customers
• wearing of a mask and / or visor for all operators
• ban on bringing gloves from outside the park
• hand washing upon arrival at reception for all customers
• provision of hydro-alcoholic solutions in the park for regular hand washing• harness disinfection after each use
• regular cleaning (twice a day) of the toilets
• display showing the gestures to be adopted.Therefore, any consumer who has purchased an entry to the Fontdouce Adventure Park agrees to comply with these measures and recognizes that they are sufficient not to initiate proceedings against the Fontdouce Adventure Park.
17 – Settlement of disputes
These conditions of online sale are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts of Saintes, notwithstanding the plurality of defendants or call in warranty.
